Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and KonaStat (“KonaStat”, “we”, “us”) and govern your use of the KonaStat app and the website at konastat.com (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least the age of digital consent in your jurisdiction (for example, 13 in the United States) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
2. Your account
You are responsible for the activity under your account and for keeping your login secure. Sign-in is provided through Google / Firebase Authentication. Notify us promptly at [email protected] of any unauthorized use. You may delete your account at any time (see our Support page).
3. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. We may update, change, or discontinue features at any time.
4. Acceptable use
You agree not to: break the law or infringe others’ rights; post unlawful, harassing, hateful, or infringing content; disrupt, overload, or interfere with the Service; scrape, crawl, or harvest data at scale; reverse-engineer, decompile, or circumvent security or access controls; use bots or automated means except as expressly permitted; or misrepresent your identity. We may remove content and suspend or terminate accounts that violate these Terms.
5. User content
You retain ownership of content you submit (posts, comments, reactions, profile details). You grant KonaStat a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content as needed to operate and promote the Service. You are responsible for your content and represent that you have the rights to share it.
6. Fantasy gameplay
KonaStat fantasy is provided for entertainment purposes only. It does not involve real-money wagering, entry fees, or cash prizes. You build squads within a salary cap and earn points derived from real match events; captains score double. Scoring, salary values, and rules are provided on a best-effort basis and may be adjusted, corrected, or changed at any time. Leaderboards and standings are illustrative and carry no monetary value.
7. Sports data and accuracy
Live scores, statistics, fixtures, and related data are sourced from third-party providers and may be delayed, incomplete, or inaccurate. The Service is for informational and entertainment purposes; do not rely on it for wagering, financial, or other consequential decisions. KonaStat is not liable for actions taken in reliance on this data.
8. Intellectual property
KonaStat and its names, logos, design, software, and content are owned by KonaStat or its licensors and are protected by intellectual-property laws. Team names, club crests, and league marks belong to their respective owners and are used for identification and editorial purposes only; their use does not imply endorsement.
9. Third-party services
The Service relies on third-party platforms (for example, Google/Firebase, Apple App Store, Google Play, Cloudflare). Your use of those services is governed by their terms and privacy policies. We are not responsible for third-party services.
10. App store terms
If you obtain the app through the Apple App Store or Google Play, you also agree to that store’s terms. For Apple: these Terms are between you and KonaStat, not Apple; Apple has no obligation to provide support or maintenance for the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limitation of liability) will survive.
12. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or accurate.
13. Limitation of liability
To the maximum extent permitted by law, KonaStat and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.
14. Indemnification
You agree to indemnify and hold harmless KonaStat from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which KonaStat is established, without regard to conflict-of-laws rules, and disputes will be resolved in the courts of that jurisdiction. (Governing-law jurisdiction to be confirmed by KonaStat.) Nothing in this section limits mandatory consumer-protection rights you have where you live.
16. Changes to these Terms
We may modify these Terms from time to time. We will update the “Last updated” date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
17. General
These Terms are the entire agreement between you and KonaStat regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
